Planning for Important End of Life Health Care Decisions ...

Do you have the necessary legal documents and advance directives in place for end of life care and medical emergencies?

By Bob DeMarco
Alzheimer's Reading Room
Lately I have been receiving more and more questions about Advance directives and legal documents for end of life care.

Shortly after I came to Delray Beach to take care of Dotty I had all of the necessary documents executed, signed, and notarized.

This included legal documents like a durable power of attorney, designation of health care surrogate, Do Not Resuscitate (DNR), and living will.

Subscribe to the Alzheimer's Reading Room

You can take several approaches to these documents. For example, you can hire an attorney to do them for you. Or, you can do what I did, go out on the Internet find what you need, get them completed and executed.

Here is a list of the some of the documents you need, or might need.

  • Durable Power of Attorney for Finances gives someone called a trustee the power to make legal and financial decisions for the person with Alzheimer's dementia.
  • Durable Power of Attorney for Health Care gives someone called a proxy the power to make health care decisions for the person with Alzheimer's dementia.
  • Living Will states the person?s wishes for health care at the end of life.
  • Do Not Resuscitate (DNR) this form tells health care staff how the person wants end-of-life health care managed.
  • Will tells how the person wants his or her property and money to be divided among those left behind.
  • Living Trust tells someone called a trustee how to distribute a person?s property and money

You can contact your State Attorney Generals' Office to obtain help and advice.

Thanks to the National Hospice and Palliative Care Organization and Caring Connections you can get all or most of the documents you need on one website.

Importantly, the documents are tailor made for each state.

Download Your State's Advance Directives

You should have all of these documents executed and available long before you need them.

Carole Larkin had a very good suggestion. Put a copy in the glove compartment of your car just in case you need them in an emergency situation.

5 Tips To Save Big On Your Next Car Loan | Mdar Finance Site

If you think about it, the most grueling part of the car-buying process, after agreeing on a price, is acquiring the right kind of loan for your new or used car. Most consumers enter the car dealership completely unprepared for the loan application process, and that lack of knowledge and planning is costing them millions of dollars every year.

If you want to create a win-win situation for you and the car dealership you purchase your car from, there are five steps to take before you sit down at the negotiation table: get your credit report, surf before buying, go local, speak the language and be prepared to negotiate.

1.) Get Your Credit Report
You can?t pick up a personal finance article, magazine or book that does not refer to the importance of knowing what is on your credit report. Despite the fact that modern media has been beating us over the head with this advice for the past couple of decades, most people do not know their credit score or check their credit report on a regular basis. You can get a copy of your report by directly contacting the three credit bureaus: Equifax, TransUnion and Experian (formerly TRW).

Not knowing your credit score and the details of your credit report before applying for a car loan is a monumental mistake. You want to have any blemishes on your report resolved before you apply for a car loan, because the results of your lender?s credit inquiry directly impact your interest rate.

Your credit report includes: basic information about you ? name, address, social security number, etc.; your late payments, any outstanding debts you have, the amount of credit available to you; any public records on you such as judgments and bankruptcies; and inquiries into your credit from potential employers or lenders.

And just because you have caught up late payments, cleared outstanding debts or cleared up any judgments does not mean these blemishes are automatically removed from your credit report. Sometimes, you need to follow up with the creditors to make sure they report your reconciliation of debt to all three credit bureaus.

In addition, identity theft and/or fraud can result in false, unfavorable records on your credit report. In January 2006, the Federal Trade Commission reported that more than 686,000 people reported identity theft and fraud complaints in 2005. Stolen identity and fraud can result in major credit report issues.

2.) Surf Before Buying
You?ll be far less tempted to impulse buy, driving away from the car dealership with a car you can?t afford if you have established boundaries in your mind before you begin.
You can save big money on your car loan if you have a budget and type of car in mind before you go shopping. One easy way to accomplish this is to go online and check out different car dealership websites.

You can compare and contrast vehicle makes, models, styles, features and pricing.

3.) Go Local
There are many national auto websites, but did you know that many local car dealerships are now online as well? The advantage of working with a local car dealership can outweigh working with the manufacturer or a national website when you want the best in quality customer service, a relationship for the lifetime of your car and the best deal on your auto loan.

The advantages of getting a loan through a local dealership is similar to the reason every town in America has a locally-owned restaurant that has regulars: local businesses have a sincere investment in the community. That interest often leads to better customer service, a more customized approach to selling, and the ability to get you a better loan than you will receive from a lender who doesn?t know ? or care ? who you are.

Lastly, the local dealership may have more than one location, increasing your options for finding the car you need but offering the same uniform auto financing options. For example, Conklin Cars Salina, a car dealer in Kansas, is also a Hutchinson car dealer and a Newton car dealer. So, if a customer goes to one dealership and does not find what they need, they can visit another location and expect the same quality customer service.

4.) Speak the Language
There?s nothing more frustrating than going through the entire car-buying process, thinking you have a good deal, and learning down the road that you were taken advantage of ? simply because you had no idea what your sales rep was talking about.

From dealer holdback to Rule of 78s , make sure you have an understanding of some of the basic industry terms that could be thrown at you during your transaction. With this knowledge, you won?t misunderstand the details or find yourself being signing a contract or paperwork that you don?t understand.

5.) Be Prepared to Negotiate
If you?ve followed the four previous steps in this article, you will be armed with the necessary tools to negotiate the best rate possible for your car loan. There?s nothing wrong with shopping around and checking with other lenders to see what kind of rate they can offer you, but you must remember that numerous inquiries into your credit report may go against you.

And, when you go through the dealer for your auto loan, the sales rep wants a long-term relationship with you. This motivates them to work harder to get the best rate possible for you. In contrast, an online or off-site lender?s interests begin and end with the loan ? but the car dealer wants you to: come back and have your car serviced, return when you want to purchase your next car, and tell your friends about them, further strengthening the dealership?s reputation in the community and increasing business.

Before you sit down to get your next auto loan, take the time to do a little homework so that you can feel confident about securing the best deal for your auto loan. Investing a little time and effort before making the deal can go a long way in creating a win-win situation for you and the car dealership.

Brazil's men's team reaches Olympic quarters

MANCHESTER, England (AP) ? Neymar set up two goals and scored from a free kick to help Brazil beat Belarus 3-1 on Sunday, securing the gold-medal favorite a spot in the quarterfinals of the men's Olympic football tournament.

Neymar?struck a well-placed right-foot shot into the left upper corner of the net in the 65th minute to break a deadlock as Brazil struggled to get near the Belarus goal despite controlling possession at Old Trafford.

Belarus opened the scoring through Brazilian-born playmaker Renan Bressan in the eighth, but Alexandre Pato equalized with a header in the 15th after a cross by Neymar, who also set up Oscar's final goal in injury time.

The victory gives Brazil six points in Group C, three more than Belarus. New Zealand and Egypt, which drew 1-1 earlier in Manchester, have one point each.

Brazil will play its last group match against New Zealand while Belarus will face Egypt.

Brazil is trying to win its first gold medal in football. The Olympic tournament is the only significant football competition the five-time world champions haven't won. The Brazilians earned silver in 1984 and 1988, and bronze in 1996 and 2008.

Neymar's goal came after he was fouled while trying to get past a defender in the top of the area. His curling shot went in high and hit the side of the net as Belarus goalkeeper Aleksandr Gutor tried to reach for the ball with his outstretched arms.

Belarus took the early lead after a cross into the area by Aleksei Kozlov, as Bressan was open to head the ball into the far corner. Bressan was born in Brazil but moved to Belarus several years ago to play football.

Brazil equalized through AC Milan's Pato, who got in front of the Belarus defense to head in a left-side cross by Neymar, who then made a great run three minutes into second-half injury time to set up Oscar's easy goal from in front of the goal.

Brazil dominated most of the match in front of more than 66,000 people at Old Trafford, but struggled to get close to the Belarus area, relying mostly on balls crossed into the box. Belarus had its opportunities in a few counterattacks.

Neymar was heavily challenged and failed to pose much of a threat until coming alive in the second half. Recently signed Chelsea playmaker Oscar wasn't able to create much although he had a few good chances to score from outside the area and showed some of his outstanding skills before finally getting his goal.

Pato was the only change to Brazil's starting lineup from the 3-2 win over Egypt, when the Brazilians got three goals in the first 30 minutes but allowed Egypt to pull closer in the second half and nearly gave the victory away. He replaced Leandro Damiao.

Belarus was coming off a 1-0 win over New Zealand in its opener.

The 23-year-old Bressan was the biggest threat for Belarus. His long-range shot just missed wide in the 17th and he almost found the right upper corner with a curling shot in the 60th.

Merkel, Monti: will do all to protect eurozone

BERLIN (AP) ? The German government says Chancellor Angela Merkel and Italian Premier Mario Monti have agreed they will do everything to protect the eurozone, and Monti will visit Berlin next month.

Government spokesman Georg Streiter said Merkel spoke by phone with Monti Saturday.

That conversation came after Merkel spoke with French President Francois Hollande Friday. The German and French leaders issued a joint statement saying they were determined to do everything to protect the eurozone.

Neither statement mentioned any specific action. Italy and Spain, the eurozone's third- and fourth-biggest economies, are struggling with high borrowing costs.

Streiter says Merkel invited Monti to visit Berlin in the second half of August and he accepted the invitation.

Apple reports 3 million Mountain Lion downloads in four days, 'most successful OS X release'

We heard some rumblings ahead of the weekend from third-party sources, and like clockwork, Apple has kicked the week off with its weekend box office returns. According to Cupertino's numbers, the latest version of OS X hit 3 million downloads in four days, making for "the most successful OS X release in Apple's history." Price has surely played a role in Mountain Lion's speedy success, running $20 for 200-plus features, according to Apple's numbers. That list includes big additions like Notification Center and AirPlay Mirroring and a selection of smaller tweaks to the decade-old operating system. More information can be found in the customarily self-congratulatory press release, after the break.

Taiwan univ sues Apple over Siri patents

TAIPEI: Taiwan's National Cheng Kung University has filed a suit against US tech giant Apple, claiming the company's Siri intelligent assistant has infringed on two of its patents.

Apple introduced the voice-activated assistant technology when launching the iPhone 4S in 2011.

But Cheng Kung University in south Taiwan's Tainan city said the technology infringes two patents held by one of its research teams, both related to speech recognition.

The team is led by Wang Jhing-fa, a professor who specialises in chip designs and neural networks facilitating speech and pattern recognition.

"We filed a lawsuit against Apple at a Federal district court in Texas Friday," Yama Chen, a legal affairs manager at the university, told AFP.

Apple Taiwan was not immediately available for comment.

Earlier this month, Chinese technology firm Shanghai Zhizhen Network Technology filed a similar claim against Apple over Siri.

The company's Xiao i Robot software, patented in 2004, operates in a similar way to Apple's personal assistant and works on the iOS and Android operating systems.

Greater China -- which includes Hong Kong and Taiwan -- has become Apple's fastest-growing region, with revenues second only to the United States.

Some jobs are shifting back to Minnesota in 'reshoring'

Two years ago, Calibur11 in Duluth did what any other cash-strapped manufacturer looking to prune costs would do: Turn to China.

But the maker of game console cases is happily shifting its manufacturing operations back to the United States, discovering that doing business overseas was more trouble than it was worth. One supplier lost the molds for the company's decorative shells while another demanded a bribe. Quality problems abounded.

"We just kind of got kicked right in the teeth dealing with China. It wasn't any fun by any means. But it helped us learn to bring stuff back to the United States," said Calibur11 owner Coy Christmas.

The hassle of operating abroad has triggered several Minnesota companies to move production stateside, a move called "reshoring" by some. Coming home not only bolsters the speed, quality and simplicity of doing business, it's also more economical than it used to be. Average wages in China have jumped 10 to 25 percent a year, hitting $4 to $6 an hour in some plants. Add in shipping and high fuel costs, and offshore manufacturing is no longer such a bargain.

The return of offshore production to America has emerged as a surprising silver lining in the U.S. economic recovery. The government doesn't track corporate reshoring efforts, but experts say they are hearing of more companies bringing work back to the States.

"Lots of very encouraging anecdotes and obviously the more of that we see, the better off we all are," said Alan Tonelson, researcher for the U.S. Industry and Business Council. ?

Since 2002, about 3.5 million manufacturing jobs have been lost nationwide. Returning jobs could create opportunities for thousands of U.S. workers.

Complications of offshoring

3M, Miken Sports, Datacard and the Outdoor GreatRoom in Eagan are among the dozen Minnesota companies that have moved production back to the United States and have created jobs in the last two years. Mark Phillips, commissioner of the Minnesota Department of Employment and Economic Development, said companies have different reasons for the change, but all have discovered that operating in China, Mexico, Poland and other countries is not always rosy.

"When you are dealing across the ocean, there are logistical issues and language issues," Phillips said. "It's not perfect [overseas]."

Christmas called Calibur11's experience in China a nightmare, with one vendor losing $700,000 in tooling equipment and another demanding a $150,000 "fee" to release his product.

"And then we found out our product was being sold on the black market. It's been a horror story," Christmas said. The company, which makes cases for popular consoles such as the Xbox 360, will now add a few employees in Duluth and many more in Chicago, where it plans to hire contractors to handle molding, assembling and packaging.

Ryan Kanne, director of the U.S. Commercial Service Office in Minneapolis, said the obstacles overseas are rising and many companies are bringing manufacturing back because of quality concerns. While it is sometimes cheaper to do business abroad, companies can keep a tighter rein on how products are made if manufacturing is done in the States.

"Some were subsidiaries [overseas] while others were contract manufacturing, but [companies] are bringing it back to the U.S. for quality control," Kanne said.

Darlene Miller, owner of Permac Industries, a high-precision machine shop based in Burnsville, said her company always had quality issues in China. In 2006, she hired a Chinese contractor to make machine blades with exacting specs. But each shipment turned up flawed, with some blades not uniform, made of the wrong material, or falsely labeled "certified." What complicated matters is that she had to buy a year's worth of blades at a time.

Miller spent thousands on an outside testing lab, but was at her wit's end after three years. "We found a Wisconsin company to make the blades. And without the shipping, testing and reject costs, they actually beat the price in China," she said.

For Dan Shimek, owner of the Outdoor GreatRoom Co. in Eagan, it became too inefficient to lean on offshoring. Shimek used to buy all his wooden pergolas from China and fiberglass fire pits and pergolas from India, but minor problems on hardware orders created major issues because reshipping took six weeks. And sometimes reorders on a hot product arrived too late, causing him to miss an entire season's worth of sales.

"The impact, for sure, is tens of thousands of dollars. And the impact to cash flow for a small business can be even more dramatic than that," Shimek said.

Today, his company makes most of its firepit and grill tables in Eagan or orders from Minnesota firms. The change, carried out over the last two years, helped Shimek become more nimble and has added about a dozen jobs to Minnesota's economy, either at his site or at contractors.

Still 'offshoring craze'

Some economists say reshoring will continue to add U.S. jobs, but others, including Tonelson, worry that the reshoring trend could remain largely anecdotal. "I think the offshoring craze is still going on," he said.

Certainly conglomerates like 3M Co. continue to operate globally. But even it has brought divisions home, when it has made sense. The Maplewood-based company said it consolidated production of its Littmann stethoscope from 14 domestic and foreign contractors to just one 3M factory in Columbia, Mo., a move that will improve efficiency for its operations.

"What we are doing is trying to shorten the supply chain," said 3M spokeswoman Jackie Berry. "We were making pieces around the world and then consolidated, so our supply cycle fell to 50 days from 165 days."

Calibur11's Christmas is expecting to increase its business. The company made and sold $4.5 million worth of gaming cases last year, and this year it will make $5 million to $8 million "and we will do it right here in the United States," Christmas said.

"I'm pumped up," Christmas said. "I'm looking forward to bringing us back to the United States."

Prepare To Die ? Z?calo Public Square

If you?re reading this, you will die. Of course, you?ll also die if you?re not reading this. Death is inescapable. We have a hard time accepting that, and we often avert our eyes from end-of-life decisions. The result is that many of us die in precisely the ways we most fear?in pain, in a hospital, alone, after aggressive but futile medical intervention. Creating a living will can help you make your death more peaceful and less agonizing. But it?s not the only thing to do. In advance of the Z?calo event ?How Doctors Die,? we asked several healthcare professionals the following question: What?s the most important thing, apart from making a living will, that you can do to take control of your final days?

Get yourself a family

The truth is, in our final days it?s unlikely we?ll be able to take control. So perhaps the question really is: What is the most important thing I can do to prepare for the end of my life? My answer is: Get yourself a family! Families make the best advocates and caregivers. Family members care for one another in ways that are mutually responsive, highly personal, and, when necessary, fierce.

If you are single, live alone, or are proudly independent, read on. Jeffersonian individualism works well in civil matters, but human beings are social animals. Our relationships are fundamental to our wellbeing?especially during times of need, including the waning months of our lives.

I?m not suggesting that you get married or adopt someone to plan for old age (not that it would hurt.) Bloodlines and marriage are not the only family bonds. At some depth of friendship, individuals are rightly considered family. Getting a family means developing a group of people who matter to you and for whom you matter.

Is caring for a vulnerable family member a burden? Yes, but it?s one that families are willing to shoulder. When someone belongs to your family, his or her wellbeing is intertwined with your own.

If you are lucky enough to already have a family, invest in it by mending or tending your relationship with each member. Remember, no one is perfect. Thankfully we love people anyway. Forgiveness, gratitude, and love sustain the healthiest of families.

You needn?t be dying to begin preparing for your final days. I suggest people ask themselves, ?What would be left undone or unsaid if any of the people I love most were to die suddenly?? You might consider saying these four things:

Please forgive me.

I forgive you.

Thank you.

I love you.

That way, whenever the time comes, you?ll be better able to say goodbye.

That much we can control.

Dr. Ira Byock is director of palliative care at Dartmouth-Hitchcock Medical Center in Lebanon, New Hampshire and author of The Best Care Possible: A Physician?s Quest to Transform Care Through the End of Life. He can be reached through www.TheBestCarePossible.org.

?????????????????????????????????????

Accept death

Paradoxically, the most important thing that we can do to take control of our final days is to realize that we won?t be in control. It goes without saying that in the end many of us will be in a weakened state both mentally and physically. We will be unable to make the most basic decisions about what happens. This is a difficult situation in a society that values control and denies death. It?s one reason why so much money is spent to keep people alive during the last six months of their lives. We must accept our mortality. Even the best and most expensive medical technology will not keep us alive indefinitely.

How do we get to this acceptance? One would expect a religious view to help, but often this isn?t the case. A study published in the Journal of the American Medical Association in 2009 found that religious patients were more likely to receive aggressive care during their last week of life. This is consistent with what I often see. A belief in miracles, even in the form of medical interventions, can work against a simple acceptance of death.

But I believe that acceptance will eventually be forced upon us. Even with reform, healthcare costs are unsustainable, and expensive end-of-life care is a major factor. When public and private insurance programs begin seriously to take on this issue, one response may be for people to face death rationally. Perhaps there will even be a growth in formal and informal discussion groups that find inspiration in things like the Serenity Prayer. In our final days we need the wisdom to accept what can and cannot be changed.

Talk in depth to family and friends

There are really two different questions here: what can be done in advance to take control of our final days, and what can be done in the moment? In advance of our own death, each of us should have conversations with our closest family members and friends outlining our feelings about treatment at the end of our lives. If we have done this, then our relatives, and friends, can help us have the kind of death we most prefer.

Intensive care units are able to keep patient?s bodies alive for days even when there is little hope of the person surviving, much less recovering. Is it your preference to have the hospital keep you alive, hoping against hope for a turnaround in health? If so, know what you are choosing: being unconscious in an intensive care unit with a tube down your airway so that a ventilator can breathe for you?and aggressive CPR if your heart does stop.

Individuals who prefer to limit the amount of medical intervention at the end of their lives will have more opportunities to talk with family members and friends throughout their decline and can die at home or in the more home-like setting of a hospice. Their pain will be controlled, their bodies cared for, and they will have much greater privacy and autonomy than the hospital typically affords.

Knowing when the time to choose has arrived can be difficult because doctors are often poor prognosticators. Press physicians for full and detailed information. Remember that how a person leaves this world should be that individual?s decision.

Create a living living will

Find yourself a living living will?a living will that is enhanced by someone with intimate knowledge of your personality and wishes. As a hospital-based internist, I know firsthand that living wills are very often a Sesame Street approach to something as complicated as a NASA shuttle launch. Do you really want Gonzo at the controls as the rockets fire? Living wills are a great cognitive exercise, a way to begin thinking about how one might want the end to go; but they cannot possibly address all the permutations that often arise in end-of-life situations.

Here?s some common living will phraseology that makes my point: ?I would want all treatment unless there was no hope of meaningful recovery.? Fine, but what does ?no hope? mean to you? One in a thousand chance? One in 10 thousand? One in a million? And trickier still, what constitutes a ?meaningful recovery?? A life where one is perpetually nursing-home-bound? At home, but unable to walk? Able to walk but unable to speak fluently?

These are some of the tricky questions that only a living living will can answer. That?s why you need someone with the personal (loves you and knows you well) and legal (power-of-attorney) authority to speak to your wishes when you cannot. And if need be, this person should be able to forcefully advocate for you, because ?Do Everything? is the American healthcare system?s current default setting, and that?s typically what you?ll get if you don?t demand otherwise. And then it?s not your life, really: it?s the system?s.

And if, because of advanced age or illness, the end seems near, consider filling out a POLST (Physician Orders for Life-Sustaining Treatment) with your physician. As a signed doctor?s order, this can be particularly valuable in emergency situations where your living living will is either not available or has yet to be notified.

Decide what matters most

The most important steps you can take to be prepared for living with a serious illness is to begin thinking about what matters most to you. Think about that you would want done if you were hit by a truck tomorrow and were in a permanent vegetative state thereafter. For example, if you are the kind of person for whom life at all costs?even if you could no longer recognize and interact with your loved ones?is the highest priority, you should tell your doctor and your family that your goal is to live as long as humanly possible no matter what. If, on the other hand, you are like most of my patients, quality of life may matter most to you. In that case, articulate to yourself and to your family and to your doctor what makes life worth living for you. It may be the ability to recognize and have meaningful interaction with the people you love. It may mean the ability to be independent and active. It may mean not being a burden on your children. It may mean being able to read or write.

As long as you have your wits about you, you can and will make your own decisions about medical care over the course of an illness. It is when (and this eventually happens to nearly all of us) we lose that ability that other people will have to make those decisions on your behalf. If you don?t know what matters most to you, how can they know? Humans are not mind readers.

If you find all of this overwhelming, then seek help from a palliative care team in your area. You can find a team in your area by visiting www.getpalliativecare.org. Palliative care is specialized medical care for people with serious illnesses. It?s focused on providing patients with relief from pain and stress. Unlike hospice care, palliative care can be applied to anyone regardless of prognosis, even when full recovery is expected.

The goal is to improve quality of life for both the patient and the family. Palliative care is provided by a team of doctors, nurses, and other specialists who work with a patient?s other doctors to provide an extra layer of support. Palliative care is appropriate at any age and at any stage in a serious illness?and it can be provided together with curative treatment.

Dr. Diane E. Meier is Director of the Center to Advance Palliative Care (CAPC).

Take four essential steps

Most of us will die of progressive chronic illnesses. In our final days, most of us will experience suffering. Some of it may be physical: pain, tiredness, shortness of breath, and nausea. Some of it may be emotional: fear, despair, family conflict, and spiritual crisis. We have engraved in our DNA that dying is not a good idea. Fortunately, there has been great progress in reducing physical and emotional suffering.

In the past 28 years of working full time in helping patients and families, I have learned that there are four things we can do to take better control of our final days.

1. Access a good palliative care team. This team should be led by a palliative medicine specialist who works with a team of colleagues, including a counselor, rehabilitation professionals, a chaplain, and a palliative care trained nurse. The team should start seeing you while you?re still receiving treatment. Palliative care units are intensive care units for physical and emotional suffering and must be on hand.

2. Get help from family and friends. For the last two months of life you will probably have great difficulty doing laundry, housecleaning, shopping, or even going to the bathroom. If no one lives with you, then you must either move in with someone you love or have someone you love move in with you.

3. Set aside money. Ending your days well can be expensive. If you have the resources, consider hiring someone to help out with chores and transportation so that family can sometimes take a break. You might also want to move to another place to receive regular care.

4. Seek spiritual and religious care. If you belong to a religious denomination, then you may want to reconnect with your community of faith. If not, take advantage of programs that will help you find meaning your life and your legacy.

These four measures will not eliminate all your suffering, but they will for sure help you live better during your final days.

Dr. Eduardo D. Bruera developed and leads the Department of Palliative Care and Rehabilitation Medicine at The University of Texas M. D. Anderson Cancer Center.

Inform yourself of the following basics

People have a basic right, protected by U.S. law, to be free of medical treatments they do not want. When a person is unable to make medical decisions, this right is protected through surrogate decision-making, authorized in all states.

Advance directives (sometimes known as ?living wills?) allow people to document any explicit instructions they may have concerning future medical treatment.
Portable medical orders (including POLST-type documents authorized in many states, see www.polst.org) are another type of documentation, suitable when a person has been diagnosed with a serious condition and medical decisions are foreseeable.

Whether or not a person wishes to complete advance directive to document explicit preferences about medical treatment, appointing a surrogate (also known as a ?proxy? or ?agent?) and discussing his or her values, preferences, and goals with the surrogate is perhaps the most important step a person can take. A knowledgeable surrogate who is prepared to make medical decisions if a person is unable to do so is able to answer the question ?What would this person want?? This is a key question when a person?s advance directives (if any) do not address the situation at hand. A knowledgeable surrogate can collaborate with physicians and other healthcare professionals to clarify the patient?s preferences and goals and to apply this information to different medical circumstances and changing conditions.

Advance care planning is a process that helps people to think about and describe their values and preferences about future medical treatment, in the context of their goals for their own lives (for example, spending time with loved ones, or seeing a child or grandchild graduate, or continuing to pursue meaningful work or interests), and to ensure that these values and preferences are known in future care. Medical professionals are increasingly aware of how to conduct an advance care planning process, including the documentation of advance directives and the identity of a patient?s surrogate. They can also help their patients to clarify their goals and preferences and develop a care plan reflecting the patient?s values. Advance care planning ideally involves the patient?s appointed or intended surrogate, as it is essential for a surrogate to be knowledgeable about the patient?s goals and preferences and to be ready to carry out the surrogate?s responsibilities if needed.

Nancy Berlinger, Bruce Jennings, and Susan M. Wolf are the authors of The Hastings Center Guidelines for Decisions on Life-Sustaining Treatment and Care Near the End of Life: Revised and Expanded Second Edition (Oxford University Press, in press).

?????????????????????????????????????

Lay out your goals?and communicate them

First, step back and decide what your goals are and how you want to live. Second, communicate those goals to your loved ones, your physicians, and the hospital where you are most likely to receive care.

Ideally, you?ll begin taking these steps long before you approach the end of life, review them regularly, and make adjustments as your health and other circumstances change. A living will is not irrevocable.

What do I mean by goals? Let?s say you are 85 and still active. You are diagnosed with cancer. Do you want to take a shot at being cured? Or do you want to live out your remaining days as normally as possible, without aggressive medical treatment?

Surgery followed by chemotherapy may buy you some extra time. But you also risk dying from the surgery, becoming debilitated by the hospital stay, and being made very sick by the chemo. If you reject aggressive treatment, the cancer is likely to kill you. But with proper pain management you may live a relatively good life for your remaining days.

Communication is much more than filling out a form. Talk to your family about your vision of the end of life. These conversations are often very hard, and family members will frequently disagree?with you and with one another. But it is important that they understand that this is your choice, and it is their job to support you.

Do the same with your doctor. If you express your wishes to her face-to-face, she is more likely to respect them. This isn?t easy in today?s often-impersonal world of healthcare. But it is possible.

Finally, assign one person to be your healthcare advocate if you can no longer speak for yourself. End of life is no time for fraught family negotiations. Put someone you trust in charge, and make sure everybody knows whom you picked and why.

Silence in Home Buying - The Ultimate Negotiation Tactic

2:00 PM By Article Directory

'; div.innerHTML = summary; } //]]> Silence in Home Buying - The Ultimate Negotiation Tactic Silence in Home Buying - The Ultimate Negotiation Tactic

A home buyer skilled in negotiation should possess several tactics in their arsenal. However, you may have never heard (pun intended) one of the most powerful tactics. The use of silence in negotiation can earn you more money per word then Arnold Schwarzenegger in The Terminator. Observe and enjoy.

Once upon a time, I represented the buyer of an apartment complex. The seller of the apartment complex was also the real estate agent selling the property. The asking price was $ 1,050,000. I went to tour this apartment complex without my buyer and at the end of the appointment, I inquired as to the asking price. The owner/agent said "It is $ 1,050,000." I employed a technique called cringing. I said "A million fifty thousand!! My buyer can't pay that. That's way too much! And then I was silent. He kind of shifted uncomfortably for a few seconds as the silence became unbearable, and then he said "Well, the best I can do is $ 960,000." He came off the price $ 90,000 in less than 20 seconds.

Suppose that, rather than staying silent and letting the seller speak next, I began talking again. What do you suppose the odds would have been of him conceding a significant chunk of money? Probably not very high. It is likely he would have let me keep talking and tell him what my buyer would pay and then use the cringe tactic on me. Silence is one of the most effective techniques in a negotiators arsenal yet one of the most difficult to master. Why is this?

Silence is difficult to master because being silent in the presence of another person is uncomfortable. The next time you are with someone, be completely silent for 15 seconds. Not while the other person is talking. When there is a break in the conversation or a verbal serve directed at you, wait 15 seconds before your return shot. You have probably just experienced the awkward silence. And you were doing it on purpose. Imagine if you didn't know this was a game and someone employed this technique on you. The anxiety that builds up is enough to make even the most introverted person babble uncontrollably. That is the power of silence.

When you are negotiating for your home and you employ a tactic or make a verbal offer, go mute and don't speak again until the other party speaks. Make it a game if you like and see who blinks first. Once the silence becomes uncomfortable to the seller, they will likely start talking and if they continue, they will likely negotiate against themselves or give you an advantageous piece of information. They may reduce the price if you have used a tactic or they may accept if you have posed an offer. But even if they don't make a concession, you have lost nothing by trying it, not even air from your lungs. You may just be surprised at how much you can gain.

SOLO TWITTER SPAT

Outspoken U.S. goaltender Hope Solo isn't happy about former player Brandi Chastain's commentary on NBC, and she's tweeting about it.

At one point, Chastain pointed out that a defender's responsibilities are: "Defend. Win the ball. And then keep possession. And that's something that (U.S. defender) Rachel Buehler actually needs to, I think, improve on in this tournament."

After the game, Solo rattled off four tweets about Chastain. She told Chastain to "lay off commentating about defending" and goalkeeping "until you get more educated" and "the game has changed from a decade ago."

"I feel bad 4 our fans that have 2 push mute," tweeted Solo, adding that she likes NBC soccer announcer Arlo White.

Chastain is one of the top all-time defenders for the U.S. team. A spokesman for NBC said the network would have no comment and that Chastain was unavailable for comment.

Experts Offer Tips to Cut Kids' Screen Time During Summer

SATURDAY, July 28 (HealthDay News) -- Lots of parents would like to avoid having their kids spend the summer watching television or playing video games.

According to the Alliance for a Healthier Generation, reducing the amount of time spent in front of a computer or TV can boost health and happiness, prompting families to do more physical activity and get creative in finding other ways to spend their time.

The nonprofit organization, which was formed to combat childhood obesity, offered tips to cut down on screen time:

  • Schedule screen time. Decide in advance what shows will be watched, what video games will be played or how much Internet time is allowed.
  • Keep track. Have children write down the amount of time they spend in front of the TV or a computer screen. If they realize they are spending more time in front of a screen than they thought, they may be motivated to change their habits.
  • Be positive. Set goals for reducing screen time and offer rewards for reaching them.
  • Do something else. Go outside, join a club, play a sport, get a hobby.
  • Designate screen-free time. Don't turn on the TV first thing in the morning. Turn off the TV during dinner. Instead, eat outside or have a family talk. Remove electronics from bedrooms.
  • Put electronics away. Try storing all electronics in one room for an entire day and not touching them, or cover screens to help you forget about them.
  • Read instead. Take the kids to the library. Allow children to stay up 15 minutes past their bedtime as a reward for reading.

John Rosatti: Classic Car Restoration

If you have been dreaming of owning one of your favorite classic cars from years ago for some time now, you should consider restoring your very own custom build hot rod or muscle car like John Rosatti, which can be a very rewarding project that will have some excellent results in the end. If you would like a custom built car that features custom designs that you have always wanted then you should think about restoring your very own classic car.

Restoring your classic car will not only get you a lot of extra looks from spectators but it can also provide you with a great investment that will be worth a lot of money if you should ever decide to part with it, notes John Rosatti. Restoring a classic car will require a lot of time, money, skills, knowledge and patience. If you are doing the restoration job on your own then you will also need special tools in order to do the job correctly. All throughout the restoration process it will be essential to tag the parts of the classic car that needs to be restored so that you will be able to go into the project with a more systematic approach.

When restoring a classic car the major part that you will be working with is the engine. The engine is known for being the heart of the car so it is recommended that a certified mechanic look at the engine especially if you are new to working on cars. Once the engine is able to start smoothly you can work on making the car look its very best by steam washing the compartment section of the engine and also repaint it. The gearbox as well as the transmission are the second most important parts of the car that need to be checked and restored, changing the oil that is located inside of the transmission is suggested. Next, explains John Rosatti, you will need to take care of the body panels; all rusty and damaged parts should be replaced.

You should always check the car windows for any cracks and need to replace the windows if necessary. Hermit Kingdom vs. House of Mouse

North Korea might have a solid legal defense, anyway. In 1928, when Walt Disney introduced Mickey Mouse to the world in the cartoon short Steamboat Willie, producers were required to place a copyright claim in their films. The statement had to include the name of the copyright owner, the year, and the copyright symbol (the letter c inside a circle). Walt Disney included all of those elements in the opening frames of Steamboat Willie, but they didn?t appear next to each other. Legal scholars refer to this as a ?dispersed copyright,? and 1920s judges usually ruled them invalid. If a clever litigant had brought a claim at the time, Mickey Mouse would probably have entered the public domain. (The result would have crushed Walt Disney, who had already failed to secure the rights to his first cartoon hit, Oswald the Lucky Rabbit.) Anyone could have pranced around in Mickey costumes or included the plucky mouse in their own movies. Modern judges are reluctant to make sweeping rulings based on such legal technicalities, however, especially when the results would cost one of the world?s largest corporations approximately $3 billion, so it?s probably unwise to challenge the Mickey Mouse copyright.
